Use of Howard Holley Photography Images are subject to the terms and conditions of this End-user License Agreement.

Howard Holley Photography End-user License Agreement

The following is a legal Agreement between you, the authorized licensee, and Howard Holley Photography. Please read this agreement carefully before using any image supplied by Howard Holley and Howard Holley Photography. By using any image you agree to be bound by this Agreement. If an unauthorized licensee licenses an image from Howard Holley Photography, as a representative of an entity that entity is still under obligation to fulfill this agreement and payment must be made in full.

1. All Howard Holley Photography images are protected under US Copyright Law and may not be used in any way without agreeing to the terms of this agreement.

2. By this Agreement, Howard Holley and Howard Holley Photography grants you a non-exclusive, nontransferable right to use the photo(s) licensed from Howard Holley Photography for the following authorized uses.

Unlimited usage term defined.

Books, magazines and other displays which are fixed in a permanent form can be distributed and displayed past the license expiration date as long as all copies of the publication or display were printed or produced during the license period or after the set number of prints have been made, whether or not the printed materials have been distributed.

Non-permanent types of media such as billboards must be re-licensed after each image expiration date has passed. If you would like a “No-Expiration” or an extended license contact me.

Authorized Types of Uses:

 A. “Printed Materials“, as part of advertisements, in editorial and/or promotional items, reports, newsletters, photojournalism and news gathering, books, magazines, brochures.
Important note: Model and Property releases are not supplied unless otherwise noted and included with the licensed image.

 B. “Video, Multimedia, Web”, as part of a television documentary, commercial, short form and long form video projects, New Mexico tourism videos, corporate video projects, PowerPoint or other interactive multimedia presentations and single domain web sites. (Web sites using a Howard Holley Photography photo must not display the image on web page after the license has expired.)

Important note: Model and Property releases are not supplied unless otherwise noted and included with the licensed image.

Unauthorized Types of Uses:
 A. Loan, rent, sell, sub-license, or otherwise transfer the right to use any image or images to any other person or entity, except to the extent that any such image has been incorporated by you into “Authorized Types of Uses”. Images licensed by Howard Holley Photography may not be sold or distributed as screen savers, desktop wallpapers or fine art prints unless incorporated as part of an authorized type of usage or as part of a separate agreement.
 

 B. You may not use any image supplied by Howard Holley and Howard Holley Photography in any form of pornography, including pornographic web sites, advertisements, or any other related usage, or in a defamatory, fraudulent or illegal manner.

 C. You may not distribute or post for download, for resell or free, any image licensed by Golden Hour Photography to any bulletin board, user-forum, webblog, newsgroup or any other type of user group.

 D. You may not, in anyway, take photo credits or creative credits for the photo or any image licensed by Howard Holley Photography as your own work.

All images are copyrighted by Howard Holley and Howard Holley Photography and are protected by US Copyright Law.

Editing:

You may crop, edit, apply color changes, use in a collage or edit the photo as needed for any usage included in authorized types of usage listed above.

Liabilities:

A. You agree to indemnify and hold harmless Howard Holley, Howard Holley Photography, and
http://www.goldenhourphotography.com, its suppliers, agents and affiliates, against any damages or liability of any kind including attorneys’ fees arising from any use of any image supplied by Howard Holley and Howard Holley Photography.

B. No model releases, property releases or other releases exist on any photograph unless specifically noted and will be included in writing. You shall indemnify the Image owner and copyright holder, Howard Holley and Howard Holley Photography against all claims and expenses, including reasonable attorneys' fees, arising out of the use of any Image where the existence of a release has not been so specified in writing by Howard Holley. In any event, the limit of liability of the copyright owner, image owner, Howard Holley shall be the invoice price of such Images.

You must comply with all intellectual property laws, including federal copyright laws, in using the image(s) provided by Howard Holley.
 

B. Neither Howard Holley, Howard Holley Photography or
 http://www.goldenhourphotography.com will be liable for damages resulting from the use, misuse or inability to use any images licensed by Howard Holley or the physical CD or digital file itself. All efforts are made to be sure that the digital files and/or CDs are virus free and free of physical defects that could lock up or otherwise disrupt, lose saved or unsaved data, or other types of computer issues resulting from using the file(s) or image CD.
 

C. All images are “AS IS” and no guarantee of specific quality is made. The images supplied by Howard Holley and Howard Holley Photography may not be adequate for all projects and no refunds will be made. You the end user are responsible for the final quality of the image in respect to your project, such as, sharpening, color, tone, levels, etc. or by not using the image in manner it is not sampled for. (up sampling by increasing pixels to the point of degradation.)

Note:The images may be up sized using quality resizing methods such as Bicubic, S-Spline or other quality resizing algorithms.

Credits
Any image used in an editorial context must have accompanying photo credits to the copyright holder Howard Holley. In commercial and advertising usage credit is requested by not required.

Archiving and Image File Storage
You may archive a copy of the image for future use as long as it is not used in anyway without re-licensing. The original file name and number must be retained with the image as long as it is under agreement and in your possession. Any renaming of image or composite that includes the image must contain the file name and/or number in either the file name,
 meta tags, or xmp information.
